New Delhi, April 24: Vice President Venkiah Naidu on Monday rejected a notice to impeach Chief Justice of India Dipak Misra signed by seven Opposition parties led by the Congress.
In the whole instance, the rulling Bhartiya Janata Party showcased its stand against the impeachment motion.
But, seven years back, when present Union Minister Arun Jaitley was the leader of Opposition in Rajya Sabha, he made counter-arguments supporting the Impeachment motion against Justice Saumitra Sen moved by Communist Party of India-Marxcist leader Sitaram Yechury.
He had said “Can we afford to have a judge whose conduct smacks of this kind of a proven misconduct and therefore when an opportunity has come where a committee of two very eminent judges and one very eminent jury has come to a finding, is there anything extraordinary in his presentation that they violated the procedures of the substantive facts there are incorrect , that we should really consider, not accepting the committee”.

“I support Yechury’s motion that this is a fit case of proven misconduct where the judge concerned must be removed from the office and the adress to the president house should be so recommended by this honourable house”.
In 2011, Justice Soumitra Sen of Calcutta High Court was India’s first judge against whom Rajya Sabha had passed the impeachment motion.
However, before the commencement of proceedings in the Lok Sabha Sen had resigned as a judge of the Calcutta High Court.
He did so after the Rajya Sabha had passed the motion making him the first judge to have been impeached by the Upper House for misconduct.
Justice Sen was held guilty of alleged misappropriation of public funds by the probe panel headed by SC judge Justice B Sudershan Reddy.
