Supreme Court allows quota in SC/ST employees promotion till Constitution bench decides on issue

New Delhi, June 5: The Supreme Court on Tuesday allowed the Union Government to provide reservation in promotion for SC/ST employee as per law, till the issue is disposed off by the constitution bench.

A vacation bench comprising of Justices Adarsh Kumar Goel and Ashok Bhushan told Additional Solicitor General (ASG) Maninder Singh, “We will say you (Centre) can go ahead with promotion as per the law”.

The ASG, representing the Centre, said that promotions for SC/ST employees came to a standstill after verdicts were delivered by several high courts in regard to this issue.

The apex court was hearing a petition from the central government challenging the Delhi High Court’s order of quashing government’s order extending reservation in promotion to employees belonging to the Scheduled Castes and Scheduled Tribes beyond five years from November 16, 1992.

According to ANI report, the Delhi High Court in August last year had passed an order saying that the government cannot blindly provide reservation in promotion to SCs and STs, until and unless there is an adequate representation for the candidate.
