Criminal charges on LK Advani, Joshi, Uma and others to be framed in Babri case

New Delhi, May 30, 2017: The Special CBI court rejected discharge petition filed by the accused and said they will be charged under Section 120B of the Indian Penal Code in the Babri case.

Senior BJP leaders LK Advani, Murli Manohar Joshi and Union minister Uma Bharti and all other BJP leaders were on Tuesday granted bail by a special CBI court in the Babri Masjid demolition case.

The special judge granted the relief to all leaders on a personal bond of Rs 50,000 each and a surety of the same. 

Last week, counsel for the accused had moved a plea in the court to exempt Advani, Joshi and Bharti from personal appearance, but it was turned down. Massive security deployment has been made outside the court.

The Special CBI court is likely to frame charges against L K Advani, Murli Manohar Joshi, Uma Bharti and other accused in the case.

The Central Bureau of Investigation had opposed dropping the charges against these leaders in the Supreme Court after which the apex court directed the special CBI court in Lucknow to hold daily hearings on the 25-year-old matter and wrap it up within two years.

Saffron party leader Vinay Katiyar, VHP’s Vishnu Hari Dalmia and a one-time firebrand Hindutva preacher Sadhvi Ritambhara will also remain present in the court. The court will also frame charges against Mahant Nritya Gopal Das, Mahant Ram Vilas Vedanti, Baikunth Lal Sharma, Champat Rai Bansal, Mahant Dharma Das and Satish Pradhan in another case related to the Babri Masjid demolition case.

All of them were named in a FIR filed after the demolition of Babri Masjid on December 6, 1992, for allegedly instigating the mob and conspiracy behind the razing of the disputed structure.

They were booked in a separate FIR while the main FIR had been lodged against the lakhs of karsewaks for demolishing the structure. The trial of saffron leaders started at a special court in Rae Bareli while the karsewaks were being tried before a Lucknow court. The CBI, however, ever dropped the conspiracy charges against these saffron leaders in 2001 and the Allahabad high court upheld the judgment in 2010.

On April 19, the Supreme Court ordered prosecution of LK Advani, Murli Manohar Joshi, Uma Bharti, and other accused of criminal conspiracy in the Babri Masjid demolition case. The Top court had called the destruction of the medieval-era monument a “crime” which shook the “secular fabric of the Constitution”, allowing CBI’s plea seeking restoration of the criminal conspiracy charge against the four BJP leaders.
