CJI Impeachment Motion: Sibal says Venkaiah’s Decision ‘Illegal’, to Challenge order in Supreme Court

New Delhi, April 23: Senior Congress leader Kapil Sibal on Monday said Vice President M Venkaiah Naidu’s decision to reject impeachment notice against the Chief Justice of India (CJI) Dipak Misra is unprecedented, ill-advised and hasty.

Addressing a press conference, Sibal stated: “It is illegal because the Chairman has passed an order which is required to be passed after a full-fledged inquiry”.

For the first time in the history of India, an impeachment motion moved by members of the Parliament was not even discussed”, he added.

“If fifty Rajya Sabha members move a motion for the impeachment of a judge, the motion has to be dealt with by the Chairman, not in his judicial or quasi-judicial capacity”.

The former union minister stated that important matters such an impeachment motion shouldn’t be disposed off in a tearing hurry. It is our privilege to move the motion.

However, following the order, the opposition has also decided to challenge Naidu’s order in the Supreme Court.

Hitting out at Narendra Modi led Centre, the Congress said “it seems to us that this government is very keen that this must not be allowed to be inquired into”.

“If you accept the charge of receiving illegal gratifications, then you must admit the motion”, he further stated.

The Congress leader said “We are fighting a battle of principles. We are fighting for truth, transparency, accountability and rule of law”.

Earlier in a day, Rajya Sabha chairman dismissed the impeachment motion against CJI Misra by seven opposition parties.
