Modi Govt unwilling to accept judges not favourable to them, says Sibal

New Delhi, April 26: Senior Congress leader Kapil Sibal on Thursday targetted the central government for not clearing Justice KM Joseph’s elevation to the Supreme Court despite the apex court recommendation. 

Addressing a press conference, Sibal said the government must immediately reconsider his appointment. “They are unwilling to accept the collegium’s recommendations but only want judges that are favourable to them”.

He further stated, “if the judiciary does not raise voice against their suppression, the democracy of the country will be under threat”.

“Collegium had stated that Justice Kurian Joseph is highly deserving of elevation. The SC website had released a notification of the same.”

Why is his position of not elevated by the Central Government?  Sibal asked.

The Apex Court Collegium had recommended the names of both Malhotra and Justice KM Joseph for elevation to the top court.

On Wednesday the Narendra Modi led Centre okayed senior advocate Indu Malhotra’s elevation as a Supreme Court judge, and kept Justice Kurian Joseph elevation on hold.

Besides this, Speaking on pleas, the Congress leader asserted “after the investigation of Judge Loya case, there were several PILs lodged. But by the recent SC judgement, PILs have been considered to be politically-motivated”.

“A PIL was filed in Nagpur bench by Suraj Lolage on 27 November 2017. This Suraj Lolage had contested for a BJP ticket in Municipal elections. He is an RSS ideologue”, he added.
