HC Asks Rajpal Yadav to Undergo Six-Day Jail Term for Contempt

Delhi High Court today directed Bollywood actor Rajpal Yadav to surrender before Tihar Jail by July 15 to serve out the remainder six days of the total 10-day imprisonment awarded to him in 2013 for filing a false affidavit in court.

Yadav had spent four days in jail from December 3, 2013 till December 6, 2013 after which a division bench of the High Court had suspended the sentence on his appeal.

A bench of justices S Ravindra Bhat and Deepa Sharma upheld the sentence awarded by a single judge in December 2013, saying Yadav’s “failure to follow procedure cannot be countenanced” as despite being given adequate time to explain his conduct “he resorted to falsehood”.

“In the present case, the long history of the litigation shows that repeated undertakings were breached; when called upon to answer why action should not be taken, the appellant and his wife gave false and evasive replies; these included affirming a false affidavit.

“In these circumstances, this court is of the view that the complaint about failure to follow the procedure prescribed cannot be countenanced; the appellant was furnished appropriate and adequate opportunity to explain his conduct, but instead he resorted to falsehood,” the court said.

The bench also said that “when the appellant (Yadav) was afforded abundant opportunities to make amends, the conduct which he displayed was deplorable, to put it mildly”.

The contempt action was initiated against the actor for misleading the court in a recovery suit filed against him and his wife by a businessman.

The single judge bench, which was hearing the recovery suit, had taken exception to the affidavit filed by Yadav on December 2, 2013 which was allegedly falsely prepared and contained forged signatures of his wife.

Annoyed by the affidavit, the court had ordered that Yadav be sent to jail for 10 days for contempt and directed that his wife, who had appeared with their child before the court, be kept in the office of the Registrar General till the rising of the court.

Delhi-based businessman M G Agarwal had filed a recovery suit against the actor and his wife for failing to repay a loan of Rs five crore which the Yadav had taken in 2010 to make his directorial debut.

BJP preventing ‘moksha’ for Sushant’s soul: Congress

On the 35th birthday of Sushant Singh Rajput, the Maharashtra Congress on Thursday slammed the opposition BJP, alleging that because of its machinations, the late Bollywood actor’s soul is deprived of ‘moksha’ (salvation).

Paying homage to the memory of Sushant, Maharashtra Congress spokesperson Sachin Sawant said in his death on June 14, 2020, the film industry lost a highly talented and upcoming star and his loss would be felt for long.

Despite a period of eight months, the real reasons behind his death have not been revealed to the people of the country although three central agencies like CBI, Enforcement Directorate and Narcotics Control Bureau have been deployed for the probe, he said.

“However, this is also a time to remember how the BJP blatantly exploited his death for its dirty politics in Maharashtra and Bihar and gaining on other fronts. They used the incident to destabilise the Maha Vikas Aghadi (MVA) in Maharashtra and misused his name to corner votes in the Bihar election last year,” Sawant alleged.

Blaming the BJP for “preventing ‘moksha’ for Sushant’s soul”, he alleged that the saffron party tried to manipulate his death to defame the Maharashtra government of Chief Minister Uddhav Thackeray and misrepresented it to the masses in the Bihar election.

“For its political designs, the BJP has deployed CBI, ED and NCB, but nothing has come out their probes so far We have been repeatedly demanding that the CBI should table the facts before the country on what has emerged from its probe. Nothing has come out even in the investigations by ED, NCB,” Sawant pointed out.

He demanded to know why the CBI is silent on the circumstances leading to Sushant’s reported suicide, why the BJP politicised his death and attempted to portray it as a ‘murder’, what was the outcome of the ED-NCB probe which were brought into the case and other aspects.

Sawant rued that owing to the BJP, Sushant’s sou’ has not been allowed to “rest in peace” and he has also been deprived of the respect and honour due to him after his death.

Earlier, the ruling allies, Shiv Sena, Nationalist Congress Party, and Congress have consistently demanded that the CBI should reveal its findings in the case to clear the doubts in the minds of the people.

On its part, the CBI has responded by saying that it has not closed the Sushant death probe case and investigations still continue.

UP man complains Mirzapur maligns district, SC notice to Amazon Prime

The Supreme Court on Thursday issued notice on plea of a Mirzapur resident complaining against the web series Mirzapur and Amazon Prime for maligning the image of his native place in Uttar Pradesh.

“Mirzapur has rich cultural value, but in 2018 Excel Entertainment has launched a web series named Mirzapur of 9 episodes in which they have shown Mirzapur a city of goons and adulteresses,” said the plea.

A bench headed by Chief Justice S.A. Bobde after a brief hearing in the matter issued notice on the plea Centre, Excel Entertainment Pvt. Ltd. and Amazon Prime video.

Mumbai: Actress Kangana Ranaut on Monday criticised Ali Abbas Zafar’s controversial new series Tandav, starring Saif Ali Khan.

Kangana slammed the series, calling it “Hindu phobic, atrocious and objectionable”.

“The problem isn’t just the Hindu phobic content, it’s also creatively poor and deprived, atrocious and objectionable on every level hence deliberately placed controversial scenes. Put them in jail not just for criminal intentions but also for torturing the viewer #tandavwebseries,” the actress tweeted from her verified account on Monday.

Kangana’s tweet comes at a time when a criminal complaint has been filed before a Delhi court seeking action against OTT platform Amazon Prime and the makers of the web series.

The complaint filed under Section 200 of the CrPC seeks summoning, commencing trial and punishing the accused persons alleging that the web series is provoking communal disharmony and is hurting the sentiments of Hindus.

Controversy arose with sections of people claiming a particular sequence featuring Mohd. Zeeshan Ayyub insults the Hindu god Shiv and also hurts Hindu sentiments.

The nine-part political web series created and directed by Zafar, features Saif Ali Khan, Dimple Kapadia, Tigmanshu Dhulia, Sunil Grover, and Gauahar Khan in key roles.

Zafar has issued an aplogy on behalf of the cast and crew.
