SC should recall Rafale verdict, try Modi government for perjury: congress

New Delhi, Dec 16 :Terming that the Supreme Court judgment on the Rafale case was “void” as it was based on “false and misleading submissions” by the Centre, the Congress on Sunday demanded that the Supreme Court should immediate recall the verdict and a notice to be issued to the Modi government for perjury and contempt of court.

Congress leader Anand Sharma said, “Government misled the Supreme Court to get a manipulated judgement and when this glaring error came to notice, they told the SC couldn’t understand English language. Therefore we demand that the SC immediately recall this judgement, which is void.”

“The Supreme Court should not entertain the Centre’s Saturday application seeking rectification of errors in the judgment,” he added.

Sharma said that the Modi government not only committed perjury by making false assertions before the court but was also guilty of breach of parliamentary privileges.

” The entire episode has dented the dignity of the highest court in the country and it should give notice to the Modi government for perjury and contempt of court,” Sharma told the media here.

“The Supreme Court judgment is not only self-contradictory but is shocking in terms of having factual inaccuracies that are a result of false and misleading submissions made by the government.

The former union minister flayed the Modi government over its Saturday plea to rectify two sentences in the para 25 of the judgment where due to “misinterpretation” by the court, saying “is” was interpreted as “has been” at one place and as “was” in another.

“What the Modi government has done is unprecedented and its curative petition adds only to the injury it has caused to the Supreme Court. Instead of admitting its lies and apologizing, it is giving grammar lessons to the Chief Justice and his fellow judges.

“The court should take serious note of this and take action against the government for perjury and contempt of court,” said Sharma, adding that the matter of breach of parliamentary privileges will also be raised in both Houses.

However, PAC Chairman Mallikarjun Kharge and the Congress have maintained that “no portion of the CAG report has been placed before Parliament or was in the public domain”.

The Supreme Court on Friday had dismissed multiple petitions seeking court-monitored probe into the purchase of 36 Rafale jet fighters holding that the decision making process was not in doubt and it cannot go into the question of pricing and choice of offset Indian partner by the French aircraft manufacturer Dassault Aviation.

Raipur, Dec 16 : Chhatisgarh Congress president Bhupesh Baghel was declared as the state’s chief minister on Sunday. The decision was taken in a meeting of the Congress Legislature Party (CLP) in Raipur where Baghel was elected by Congress MLAs.

Bhupesh Baghel is credited with playing a crucial role in a landslide victory of the Congress in Chhattisgarh.

Baghel and three other contenders for the top post had met Congress chief Rahul Gandhi at his Tughlaq Lane home in Delhi on Saturday. Gandhi held hectic parleys with the four leaders : Mr Baghel, TS Singh Deo, Tamradhwaj Sahu, Bhupesh Baghel and Charan Das Mahant .

The sources also dismissed reports that one of the contenders, Sahu, threatened to quit the party if he was not made the Chief Minister.

The sources also indicated that unlike Rajasthan, there would be no deputy chief minister.

Representing Patan Assembly constituency in Durg district, Baghel is the President of Chhattisgarh Congress since October 2014.

Punia said the meeting of the newly-elected lawmakers will be held at 12 p.m on Sunday and the name of the new Chief Minister will be announced thereafter.

Earlier in the day, Gandhi tweeted a picture of himself flanked by all the four claimants to the post, hinting at the end of tussle over who would be the next Chief Minister of Chhattisgarh.

Posting pictures of Baghel, Deo, Sahu and Mahant — Gandhi quoted American internet entrepreneur Reid Hoffman saying: “No matter how brilliant your mind or strategy, if you’re playing a solo game, you’ll always lose out to a team.”

The Congress President had earlier tweeted similar pictures of Madhya Pradesh Chief Minister-designate Kamal Nath and his rival claimant to the post Jyotiraditya Scindia as well as Rajasthan Chief Minister-designate Ashok Gehlot and his state party chief Sachin Pilot who has been named as the Deputy Chief Minister.
